Agreement to Terms

By accessing our website datolivo.com or engaging our inspection services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Description of Services

DatOlivo provides pre-purchase technical inspection services for residential apartments in Chile. Our services include visual inspection, equipment-based testing, and written reporting of observable conditions at the time of inspection.

Scope of Inspection

Our inspections include assessment of:

  • Structural elements and building components
  • Moisture detection and water infiltration
  • Electrical systems and installations
  • Plumbing and sanitary systems
  • Windows, doors, and weather sealing
  • HVAC and ventilation systems
  • Building common areas and shared facilities

Limitations of Inspection

Our inspections are visual and non-invasive. We do not:

  • Perform destructive testing or remove building materials
  • Inspect areas that are inaccessible or obstructed
  • Provide property valuations or price opinions
  • Offer legal, financial, or investment advice
  • Guarantee future performance of systems or components
  • Inspect for environmental hazards unless specifically contracted

Client Responsibilities

As a client, you agree to:

  • Provide accurate property information and access arrangements
  • Ensure all areas to be inspected are accessible
  • Obtain necessary permissions for property access
  • Provide payment according to agreed terms
  • Use inspection reports for informational purposes only
  • Not rely solely on the inspection report for purchase decisions

Inspection Reports

Inspection reports are provided for the exclusive use of the client who contracted the inspection. Reports document observable conditions at the time of inspection and are not transferable to subsequent property owners or other parties without our written consent.

Reports are delivered within 48 hours of inspection completion. The information contained in reports reflects conditions observed during the inspection and should not be considered comprehensive or exhaustive.

Limitations of Liability

Our liability is limited to the fee paid for the inspection service. We are not liable for:

  • Conditions that were not visible or accessible during inspection
  • Future failures or defects that develop after inspection
  • Consequential or indirect damages arising from inspection findings
  • Decisions made based on inspection reports
  • Third-party actions or omissions

No Warranties or Guarantees

We provide technical assessment services based on observable conditions. We do not warrant or guarantee:

  • That all defects or problems will be identified
  • Future performance of systems or components
  • Compliance with all applicable building codes
  • Absence of defects in areas not inspected

Scheduling and Cancellation

Inspection appointments must be scheduled in advance. Cancellations made less than 24 hours before the scheduled inspection may be subject to a cancellation fee. We reserve the right to reschedule inspections due to weather conditions, property access issues, or other circumstances beyond our control.

Payment Terms

Payment is due upon completion of the inspection unless alternative arrangements have been made in advance. We accept payment via bank transfer, credit card, or other agreed methods. Late payments may be subject to interest charges.

Intellectual Property

All inspection reports, photographs, and materials provided by DatOlivo remain our intellectual property. Clients receive a license to use reports for their intended purpose but may not reproduce, distribute, or commercially exploit our materials without written permission.

Confidentiality

We maintain confidentiality regarding client information and inspection findings, except as required by law or with client consent. Clients agree not to disclose our inspection methodologies or proprietary processes to third parties.

Dispute Resolution

Any disputes arising from these Terms of Service or our inspection services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the jurisdiction of Chilean courts in accordance with Chilean law.

Indemnification

You agree to indemnify and hold DatOlivo harmless from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes become effective upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any inspection contract, constitute the entire agreement between you and DatOlivo regarding our services and supersede all prior agreements and understandings.
